진화론적 인지과학을 고려한 책임개념과 책임원칙의 재조명
This study reexamines the principles and concepts of responsibility in criminal law from the perspective of evolutionary cognitive science. It proposes a shift towards a cognitive judgment of responsibility, considering cognitive factors such as optimism bias and overconfidence, based on the view of humans as beings with bounded rationality, and expects this to bring the standards of blame and crime prevention closer together and mitigate the conflict between retributivism and consequentialism. Furthermore, it argues that the criteria for determining alternative possibilities should be based on the minimal norm person, not the actor or the average person, which further emphasizes the significance of citizen participation and jury trials.
