Summary

This study identifies the legislative spirit and current status of school autonomy ordinances and analyzes the legislative disputes between the Ministry of Education and city/provincial councils surrounding the ordinances of Gwangju and Jeollabuk-do. The legislative spirit of school autonomy was defined in terms of the relationship with Article 31, Paragraph 4 of the Constitution regarding educational principles and Article 117, Paragraph 1 regarding educational decentralization linked to local autonomy, and the current status was examined focusing on related laws and ordinances. As a result, a revision plan for school autonomy-related laws and regulations was proposed.
