Summary

This study focuses on the conflict between the commercial value of smartphone location-based advertising based on personal information utilization and consumer rights, pointing out that existing research is focused on privacy issues. It analyzes location-based advertising as information trading from the perspective of conflicting rights between information providers and users, and examines whether the current “Location Information Protection and Utilization Act” fairly reflects individual rights and freedom of commercial expression.
