‘심리적 부검’에 의한 공무상 질병의 판단 - 대상판결 : 서울고법 2013. 12. 19. 선고 2012누27505 판결 -
This case is the first in Korea to utilize a ‘psychological autopsy’ as forensic evidence and recognize a worker's suicide due to work-related stress and depression as an occupational disease. The psychological autopsy is a new method of assessment that can overcome the limitations of existing criteria for recognizing occupational diseases, and it is necessary for courts to actively utilize psychological autopsies and conduct related research. However, it emphasizes the legal validity of the psychological autopsy results and the importance of the judge's independent judgment, and raises the need to improve the Industrial Safety and Health Act and the health check-up system to protect workers' mental health.
