This study aims to clarify the requirements for tort liability arising from the provision of misinformation by analyzing existing precedents and theories, and comparing them with the laws of Germany, the United Kingdom, and the United States. The illegality of providing misinformation requires additional evidence of illegality due to the principle of caveat emptor, and can be recognized as a breach of duty when the information recipient has justifiable reliance. The scope of responsibility of the information provider should be determined based on the purpose of the information and foreseeability.
