This study points out the lack of legal stability and predictability in regulations on unfair labeling and advertising, and emphasizes the need to establish a reasonable standard for calculating fines considering consumer perception and liability for damages. Currently, many cases of violation of the Labelling and Advertising Act are processed with a fixed fine due to inaccurate sales calculations, which does not align with the purpose of the penalty system. Therefore, it is urgent to prepare a specific standard for calculating fines to deter illegal acts and recover unjustifiable gains.
