비행보장수당의 통상임금 해당성 - 서울남부지방법원 2014가합10336 판결, 서울고등법원 2015나2070165 판결을 중심으로 -
This paper critically examines the court's fixedness-centered approach to determining whether a flight guarantee allowance constitutes an ordinary wage, and aims to contribute to resolving future ordinary wage lawsuits by specifically examining the conceptual indicators of predetermined wage, uniformity, and fixedness. Recently, the court ruled that the flight guarantee allowance does not meet the requirements for ordinary wage because its payment and amount vary depending on the condition of "30 hours of flight per month." Ordinary wage-related lawsuits are unfolding around the requirements of fixedness and the application of the principle of trust and good faith, and controversy is expected to continue due to inconsistent rulings by the courts.
