This paper examines the legal status and role of patient guardians in informed consent for medical procedures, focusing on surrogate decision-making and shared decision-making. It comparatively analyzes the legal status that can be granted to guardians depending on whether the patient has decision-making capacity, and seeks ways to guarantee the patient's self-determination in Korea, where family involvement is high.
