This study analyzes the legal issues of AI-based Robo-Advisor (RA) investment and proposes regulatory measures to protect investors. While RA investment offers advantages such as low cost, issues such as conflicts of interest and the quality of investment advice exist, necessitating active regulation in terms of regulatory fairness with existing financial investment businesses and investor protection. In particular, strengthening the disclosure obligations of RA companies and imposing the suitability principle and duty of explanation under the Capital Markets Act are crucial for enhancing investor protection.
