This study analyzes the current status and problems of the military legal system for crimes committed by military personnel and civil servants. It points out human rights violations against soldiers, such as the Yoon Il-il case, and the unfairness of military trials, and presents the limitations that still exist despite the 2016 amendment of the Military Court Act. It analyzes specific problems such as military courts, the authority of jurisdictional officers, the arbitrator system, and the investigation structure of military prosecutors, and emphasizes the need to prepare fundamental solutions.
