Summary

This study analyzes the contentious issue in the BBNJ negotiations regarding the relationship between the principle of freedom of the high seas and the principle of common heritage of mankind, both key principles of UNCLOS. There is a divergence of opinion among states as to whether the two principles are mutually exclusive or coexist, and this study clarifies that the two principles were established to apply to different geographical and material scopes by reviewing conceptual backgrounds, history, and proceedings. Ultimately, the study concludes that the two principles are separate and distinct, making compatibility or potential conflict difficult to argue.
