재택구금제도의 필요성 및 도입방안에 관한 연구
This study explores the necessity and introduction plan of home detention to protect the defendant's right to defense and human rights, alleviate correctional facility overcrowding, and prevent the severance of social relationships for inmates. Home detention can be applied to cases with no risk of escape or destruction of evidence, short-term sentences, or minor, negligent, and first-time offenders, and can be considered as an alternative for inmates such as the elderly, patients, and pregnant women who have difficulty serving time in correctional facilities. Supervision of home detention subjects is handled by probation offices, with decisions made by the court with the consent of the subject and their family members.
