Summary

This study discusses the "acting in the scope of their employment," a key issue in determining employer responsibility in workplace sexual harassment cases. Courts are increasingly recognizing employer liability for sexual harassment, and while it is necessary to broadly recognize the employer's responsibility for damages occurring within the work area to protect victims, it is not desirable to impose unconditional liability for all sexual harassment or to deny the possibility of exemption for employers who have thoroughly implemented prevention and post-incident measures. Therefore, this study aims to derive implications for the relationship between sexual harassment and acting in the scope of their employment by analyzing US Supreme Court precedents and recent Korean Supreme Court rulings.
